Terms of Service

1. Parties

These Terms and Conditions ("Terms") form a binding agreement between:

BlueBuck Research LLP — a limited liability partnership registered in West Bengal, India, operating the CartIn AI service at cartinai.shop and app.cartinai.shop ("we", "us", "CartIn AI")

and

You — the individual or business entity that creates an account and uses the CartIn AI service ("merchant", "you")

By creating an account or using any part of the CartIn AI service, you agree to be bound by these Terms.

2. The Service

CartIn AI provides an AI-powered shopping agent that merchants embed on their Shopify stores. The service includes:

• An AI chat widget for storefront visitors
• A merchant dashboard at app.cartinai.shop
• Shopify product sync and AI context generation
• Analytics and lead capture tools
• API access (Pro plan and above)

The service is provided on a subscription basis. Plan details and pricing are available at cartinai.shop/pricing.

3. Account Registration

To use CartIn AI, you must:

• Provide an accurate email address and create a secure password
• Be at least 18 years of age or have legal authority to enter into contracts on behalf of a business
• Have a valid Shopify store or equivalent eCommerce presence

You are responsible for all activity that occurs under your account. Keep your credentials secure. Notify us immediately at support@cartinai.shop if you suspect unauthorised access.

We do not offer account creation via Google, Facebook, or any third-party social login.

4. Acceptable Use

You may use CartIn AI for lawful eCommerce purposes — helping your customers find products, answer queries, and make purchases.

You may not use CartIn AI to:

• Sell or promote illegal products or services
• Engage in fraud, deception, or misrepresentation to end users
• Collect visitor data beyond what CartIn AI's lead capture feature permits
• Attempt to reverse-engineer, scrape, or extract the CartIn AI system prompts or AI models
• Use the service to compete with CartIn AI or build a substantially similar product
• Violate the Shopify Partner Program policies or Shopify's Terms of Service
• Harass, abuse, or deceive visitors interacting with the widget

We reserve the right to suspend accounts that violate these rules without prior notice.

5. Shopify Integration

When you connect your Shopify store to CartIn AI, you grant us permission to access your store's product, inventory, and order data as described in our Privacy Policy. This access is governed by Shopify's API Terms of Service in addition to these Terms.

You are responsible for ensuring your use of CartIn AI complies with Shopify's Merchant Terms of Service and applicable laws in your jurisdiction.

6. Your Data

You retain full ownership of:

• Your Shopify store's product data
• Your customers' conversation data
• Any leads captured through the CartIn AI widget

We process this data on your behalf to provide the service. We do not claim any ownership or rights over your store's data.

When you delete your account, we will delete all your data within 30 days, except where we are required by law to retain it (such as payment records).

7. Subscription and Payment

CartIn AI is offered on monthly and annual subscription plans. By subscribing:

• You authorise us to charge your payment method on a recurring basis
• Annual plans are billed upfront and include a discount equivalent to two months free
• Prices are in Indian Rupees (INR) unless otherwise stated
• Overage charges apply when your conversation volume exceeds your plan limit

Cancellation: You may cancel at any time from your dashboard. Cancellation takes effect at the end of your current billing period. We do not offer refunds for partial months.

Free plan: The Free plan is provided at no cost with limitations described at cartinai.shop/pricing. We reserve the right to modify or discontinue the Free plan with 30 days' notice.

8. Intellectual Property

The CartIn AI service — including the dashboard, the widget code, the AI system design, and all associated software — is the intellectual property of BlueBuck Research LLP.

You may not copy, reproduce, modify, or create derivative works of the CartIn AI software or interface without our written permission.

You retain all intellectual property rights in your store's product content, brand assets, and customer data.

9. Uptime and Service Availability

We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance where possible.

We are not liable for:

• Downtime caused by Shopify, Anthropic, Supabase, Vercel, or other third-party infrastructure
• Service interruptions caused by force majeure events
• Data loss resulting from circumstances outside our reasonable control

10. Limitation of Liability

To the maximum extent permitted by applicable Indian law:

• Our total liability to you for any claim arising from your use of CartIn AI is limited to the amount you have paid us in the 3 months immediately preceding the claim
• We are not liable for indirect, consequential, or incidental damages — including lost profits, lost sales, or loss of data — even if we were advised of the possibility of such damages

Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be excluded by Indian law.

11. Disclaimer

The CartIn AI service is provided "as is" and "as available". We make no warranties — express or implied — about the accuracy of AI-generated responses, the completeness of product recommendations, or the fitness of the service for any specific purpose.

AI responses may occasionally be incorrect. You are responsible for reviewing the information CartIn AI provides to your visitors and ensuring it is consistent with your actual product, pricing, and policy information.

12. Termination

By you: You may delete your account at any time from the dashboard. Deletion is permanent.

By us: We may suspend or terminate your account immediately, without notice, if:

• You violate these Terms
• Your account is involved in fraud or illegal activity
• Continued operation poses a risk to other merchants or visitors

On termination, your access to the dashboard and widget stops immediately. We will delete your data within 30 days as described in our Privacy Policy.

13. Changes to These Terms

We may update these Terms when the product or law requires it. We will:

• Notify you by email at least 14 days before material changes take effect
• Update the "Last updated" date at the top of this page

Continued use of CartIn AI after the notice period means you accept the revised Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the Republic of India.

If a dispute arises, both parties agree to first attempt resolution informally by contacting support@cartinai.shop.

If informal resolution fails within 30 days, disputes shall be subject to the exclusive jurisdiction of courts in West Bengal, India.

15. Severability

If any provision of these Terms is found to be unenforceable under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable. All other provisions remain in full force.
